The Mobile Banking Card Guard® service is an online card management Application ("Application") provided by America First Federal Credit Union ("America First Credit Union," "Credit Union"), the issuer of the debit or credit card of yours, which you can manage within the Application.

By downloading or using the America First Mobile Banking Application, you agree to the terms and conditions set forth herein, as well as all other policies or agreements of the Credit Union referenced herein. In addition, you agree that you are solely responsible for actions and communications undertaken or transmitted under your account, and that you will comply with all applicable local, state, and federal laws and regulations related to your use of or activities on the Application.

These terms apply exclusively to your access to and use of the Application and do not alter the terms or conditions of any credit card or debit card agreement you may have with the Credit Union.

USE OF AFCU MOBILE BANKING CARD GUARD APPLICATION. Card Guard may be used only for the following purposes:

• obtaining information about a card and card transactions;
• establishing card and transaction authorization controls of your card, including: location, transaction types, merchants, and transaction threshold amounts;
• reviewing the status of your card account and transactions;
• establishing card acceptance or use (on/off) controls;
• establishing transaction alerts and messages to and from the Credit Union; and
• coding or tagging transaction data for your personal records.

You are solely responsible for all information and data you input into the Application, the controls, authorizations, and security codes you establish, and any access you give to any other person to the Application or your card account.

RESTRICTIONS ON USE. In order to use the Application, you must be an America First Credit Union member and a resident of the United States. In addition, use of the Application is restricted to personal, family, or household use. The Application may not be used for commercial purposes. If you do not satisfy the above restrictions on use, please do not use the Application or download materials from the Application. You agree to comply with all additional restrictions provided in the Application, as it may be updated from time to time. The Application, including all materials, is copyrighted and protected by copyright laws.

USER CONDUCT. By using the Application, you agree:

• not to disrupt or interfere with the security of, or otherwise abuse, the Application or any services, system resources, accounts, servers, or networks connected to or accessible through the Application or affiliated or linked Web applications;
• not to disrupt or interfere with any other user's access or use of the Application or affiliated or linked applications;
• not to upload, post, or otherwise transmit through or on the Application any viruses or other harmful, disruptive, or destructive files;
• not to use or attempt to use or access another person's account or personal information or create or use a false identity on the Application;
• not to attempt to obtain unauthorized access to the Application or portions of the Application which are restricted from general access; and
• not to use any automatic device or manual process to monitor, extract, collect, harvest, or copy the Web pages or any data or data fields contained at the Application, including, but not limited to, personally identifiable information of any other user of the Application.

DISCLAIMER. THE CREDIT UNION DOES NOT MAKE ANY WARRANTY THAT YOUR USE OF THIS APPLICATION OR THE MATERIALS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, ORTHAT DEFECTS, IF ANY, WILL BE CORRECTED. THE CREDIT UNION ASSUMES NO RESPONSIBILITY FOR DAMAGES THAT MAY BE SUFFERED BY YOU, INCLUDING BUT NOT LIMITED TO LOSSES FROM DELAYS, NONDELIVERIES OF CONTENT OR ANY COMMUNICATIONS, ERRORS, SYSTEM DOWNTIME, MISDELIVERIES OR MISCOMMUNICATIONS, NETWORK OR SYSTEM OUTAGES,FILE CORRUPTION, OR SERVICE INTERRUPTIONS CAUSED BY THE NEGLIGENCE OF THE CREDIT UNION AND LICENSORS, OR YOUR OWN ERRORS AND/OR OMISSIONS. THE APPLICATIONAND MATERIALS ON THE APPLICATION ARE PROVIDED "AS IS" WITHOUT ANY REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND, INCLUDING BUT NOT LIMITED TOWARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, OR FITNESS FOR ANY PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW FOR THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

PRIVACY POLICY AND YOUR INFORMATION. The Credit Union does not want you to, and you should not, send any confidential or proprietary information to the Credit Union via the Application, except for certain information necessary to use the Application in the manner set forth above. You agree that, except as provided in the Credit Union's Privacy Policy, any information or materials that you or individuals acting on your behalf provide to the Credit Union will not be considered confidential or proprietary. By providing any such information or materials to the Credit Union, you authorize the Credit Union to disclose or transmit and distribute such information and materials as necessary to provide the AFCU Mobile Banking Card Guard service, except as limited by the Credit Union's Privacy Policy.

THIRD-PARTY APPLICATIONS. As a convenience, the Credit Union may provide, on the Application, links to Web applications operated by other entities. If you use these applications, you will leave the Application. If you decide to visit any linked application, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or other destructive elements. The Credit Union makes no warranty or representation regarding, and does not endorse, any linked Web applications or the information appearing thereon, or any of the products or services described thereon. Links do not imply that the Credit Union or the Application sponsors, endorses, is affiliated or associated with, or is legally authorized to use any trademark, trade name, logo, or copyright symbol displayed in or accessible through the links, or that any linked application is authorized to use any trademark, trade name, logo, or copyright symbol of the Credit Union or any of its affiliates or subsidiaries.

LIMITATION OF DAMAGES/WAIVER: The Credit Union's liability for any claims, damages or losses for unauthorized use of your card or improper card transactions will be limited as set forth in the credit card or debit card agreement with the Credit Union. IN NO EVENT SHALL THE CREDIT UNION BE LIABLE TO YOU OR ANY PERSON FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION OR PROGRAMS, OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM) THAT ARE RELATED TO THE USE OF, OR THE INABILITY TO USE, THE CONTENT, MATERIALS, AND FUNCTIONS OF THE APPLICATION OR ANY LINKED APPLICATION, EVEN IF THE CREDIT UNION IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. You release, discharge, and hold harmless the Credit Union and its respective directors, officers, employees, and agents from any and all liability, claims, or causes of action (known or unknown) arising out of our or their negligence in connection with the Application, including, without limitation, liabilities arising out of information posted on the Application or otherwise provided by the Credit Union.

TELEPHONE AND COMMUNICATION CHARGES & EQUIPMENT. You acknowledge that you have the appropriate computer equipment and Internet access to use the Application and understand that your use of the Internet may incur certain operational costs, such as monthly fees for a service provider. You are solely responsible for any and all telephone and other communication charges and equipment costs relating to your use of the Application. All transmissions by you via the Application shall be at your sole risk and the Credit Union will not be responsible for any communication line failure, equipment, or systems failure or other such occurrence.

AMENDMENTS. The Credit Union reserves the right, at its sole discretion, to change, modify, add, or remove any portion of this Agreement in whole or in part, at any time. Changes in this Agreement will be effective when notice of such changes is posted on the Application. Your continued use of the Application after any changes to this Agreement are posted will be considered acceptance of those changes. The Credit Union may terminate, change, suspend, or discontinue any aspect of the Application, including the availability of any features of the Application, at any time. The Credit Union also may impose limits on certain features and services or restrict your access to part or all of the Application without notice or liability. The Credit Union may terminate your use of the Application at any time, at its sole discretion.

ENTIRE AGREEMENT. These terms and conditions, and the credit card and debit card agreements and Privacy Policy as referenced above, constitute the entire Agreement between the Credit Union and you with respect to the terms of use for the Application. If for any reason a court of competent jurisdiction finds any provision of this agreement or portion thereof to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of this Agreement, and the remainder of this Agreement shall continue in full force and effect.
